The running costs for these services are not included in the purchase price.
This is not a financial product and does not constitute investment advice. Trading cryptocurrencies involves substantial financial risk. You can lose your entire invested capital. Only use the agent with capital whose loss you can afford.
The licensor is liable without limitation for intent and gross negligence, for culpable injury to life, body or health, and under the German Product Liability Act. In cases of simple negligence, the licensor is only liable for the breach of essential contractual obligations (obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely), limited to the foreseeable damage typical for this type of contract. Any further liability is excluded.
Trading results: the software makes trading decisions autonomously on the basis of market data and AI analysis; no particular trading result is promised or owed (see section 5). Losses from trades that the software executes within its intended function are not a defect of the software and do not give rise to any liability of the licensor. Your statutory rights in the event of defects of the software itself (section 10) remain unaffected.
Best-effort support by e-mail (info@noxtrade.de), response time usually 1–3 business days, in English or German. Support covers installation questions, technical bugs and configuration help — not trading strategy advice.
The licensor provides updates that are necessary to keep the software in conformity with the contract (including security updates) for the period you can reasonably expect given the nature of the contract (§ 327f BGB). Updates beyond that, new features or strategy improvements are provided at the licensor's discretion; there is no entitlement to them.
This licence is valid indefinitely from the date of purchase. The licensor may terminate the licence if you breach these terms. Upon termination you are obliged to remove the software from all systems.
Right of withdrawal: as a consumer you generally have a 14-day right of withdrawal (see the withdrawal notice). It expires early if, during the order process, you expressly consented to immediate delivery, confirmed your knowledge of the expiry, and delivery has begun (§ 356 (5) BGB).
Statutory warranty rights: your statutory rights in the event of defects of digital products (§§ 327 et seq. BGB — subsequent performance, termination, price reduction, damages) remain unaffected by this agreement and are not restricted by anything in this EULA. Report defects to info@noxtrade.de — we will take care of subsequent performance promptly.
Goodwill refunds beyond that (e.g. “I don’t like it”) are excluded due to the digital nature of the software and its immediate delivery.
The software contains a telemetry feature that is disabled by default. Only if you enable it (during installation or in the dashboard) does the software transmit the following data to NoxTrade once per day: timestamp, trading symbol, public market indicators (e.g. RSI, MACD, trends, price), the AI's decision (action, confidence, reasoning, relative parameters in per cent), the number of open positions, whether test mode (paper) is active, and the software version. For attribution, a non-reversible hash of your licence key is transmitted — not your e-mail address or name.
Not transmitted: account balances, portfolio values, absolute amounts, API keys, credentials or any other personal data.
The purpose of the processing is analysing and improving the trading strategy and, where applicable, training our own models. The legal basis is your consent (Art. 6 (1) (a) GDPR); it is voluntary, use of the software does not depend on it, and you can revoke it at any time in the dashboard with effect for the future. You can have already-transmitted data deleted: informal e-mail to info@noxtrade.de stating your licence e-mail address. The data is stored on servers in Germany and is not shared with third parties.
This agreement is governed by German law. If you are a consumer habitually resident in another country, the mandatory consumer protection provisions of that country remain available to you (Art. 6 Rome I Regulation). If the licensee is a merchant, a legal person under public law or a special fund under public law, the exclusive place of jurisdiction is the licensor's registered seat; for consumers, the statutory places of jurisdiction apply.
